and conditions. We reserve the right to refuse service and revoke rights to use
this site to any one at our sole discretion. These conditions may be updated at
any time, without notice.

any legal requirement that such communications be in writing.

This property is protected by U.S. and international copyright laws. You may not
store (other than temporary page caching for your personal viewing purposes), copy,
modify or distribute content from this site without express written permission from
Mogiz, LLC.

MoGiZ, MoGiZ.com and Mogiz, LLC are trademarks of Mogiz, LLC. These trademarks may
not be used in connection with any product or service that is not offered by Mogiz,
LLC. Also, these trademarks may not be used in a manner that is likely to cause
confusion among customers, or in any manner that disparages or discredits Mogiz,
LLC in any way.
All other trademarks that appear on this site not owned by Mogiz, LLC are the property
of their respective owners.
Your Account
If you are under the age of 18, you may only use this site and your account under
the supervision and permission of a parent or guardian. You are responsible to maintain
the confidentiality of your account and password. You are also responsible for restricting
access to your computer or other access devices that would reduce the confidentiality
and security of your account.
You agree to notify MoGiZ.com immediately if you detect unauthorized use of your
account. You also agree to sign out of your account at the end of each session to
help protect your account. You agree to accept all responsibility for all activities
that occur under your account and/or password.
MoGiZ.com reserves the right to refuse service, terminate accounts and remove or
edit content at our sole discretion.
Payments and Billing
You agree to only make purchases on MoGiZ.com using payment accounts that you are
permitted to use through the respective payment service company.
Sales Tax
MoGiZ.com is only required to charge sales tax to the purchaser for products shipped
to states where our business resides. All orders shipping to Idaho will be charged
the applicable state sales tax.
Shipping
MoGiZ.com currently only ships within the United States, and uses a variety of couriers
at our sole discretion. We attempt to ship orders as quickly as possible (usually
by the end of the business day following the date the order was placed), but do
not guarantee shipping times. We do not refund shipping charges for shipping delays.
Damaged, Incorrect, Incomplete, Lost Packages
MoGiZ.com may, at our sole discretion, refuse refunds and/or payments related to
disputes that arise as a result of packages that arrive damaged, are missing items,
are incorrect, or that get lost in transit.
Order Cancellations
MoGiZ.com will attempt to process order cancellations, but we do not guarantee that
orders can or will be cancelled. Due to the nature of our suppliers, sometimes cancelling
an order is not possible.
Stocking, Backorders and Order Changes
MoGiZ.com attempts to display only products that are believed to be in stock and
ready to ship. Due to the high volume of orders and nature of our suppliers, keeping
this information 100% correct is not possible. We cannot guarantee that items are
in stock.
If an order is placed for an item we determine to be out of stock when processed
for shipping, will remove that item from the order, process the remaining items
on the order, and refund the difference. MoGiZ.com does not hold orders open for
backordered product.
MoGiZ.com cannot process additions or changes to orders (adding products and/or
swapping products).
Site Accuracy
We make every effort possible to ensure the content listed on our site is accurate
and current. Unfortunately, there will be times when products change without notice,
or incorrect information is mistakenly posted on our site. MoGiZ.com will not be
held responsible for these errors. In the event that incorrect information is discovered
on our site, we will attempt to work with our customers to resolve the conflict.
If the conflict cannot be resolved in a manner that is mutually satisfying for both
parties, we reserve the right to cancel the order, refuse payment/refund, and/or
refuse service.
Product Satisfaction Guarantee and Return Policy
MoGiZ.com offers our customers a 15/30 day satisfaction guarantee for orders placed
on our site (excluding membership and sellers fees which are non-refundable). You
must notify MoGiZ.com within 15 days if you did not receive the expected items or
if you wish to return your items for a refund. If you do not notify MoGiZ.com within
15 days that you did not receive the correct items on your order (quantity and type)
or that you want to return an item for a refund, the funds are released to the seller
and may not be available for refund. If your product fails within 30 days, you can
notify MoGiZ.com for an exact item exchange.
If you wish to return your product and you have notified MoGiZ.com within the required
timelines above, you must follow the steps below in the order they are listed:
- You must obtain an RMA number from MoGiZ.com before you return your product(s).
- The RMA number has to be prominently displayed on the return shipping package.
- MoGiZ.com utilizes many suppliers. Some returns may require packages being shipped
to several locations. You must follow the return instructions emailed to you after
requesting your RMA to ensure your packages are returned to the right location.
- All returned products must be 100% complete in the condition you received it. This
includes the original packaging materials, documentation, accessories, batteries,
and anything else that originally came with the product.
- The returned product must be packaged in a way to prevent damage during shipping.
- The product has to be shipped within 10 days after MoGiZ.com issues you an RMA number
using a reputable carrier that offers proof of delivery and insurance for the entire
value of the shipment.
MoGiZ.com will not refund original shipping charges or cover return shipping costs
for any reason. The customer agrees to bear all risk of loss for the return product
during shipment.
MoGiZ.com will assess a 15% restocking fee for any product that is returned and
not exchanged for the exact same item (10% for Plus members, 5% for Premium members).
If product comes back damaged, incomplete, not resalable, or if any of the steps
were not followed above, MoGiZ.com reserves the right to refuse the refund or assess
additional fees to complete the refund transaction.
MoGiZ.com does not guarantee to have an item in stock for an exact item exchange.
If we are out of stock, we will (at our own discretion) coordinate an exchange for
a similar item or process a refund.
MoGiZ.com Memberships and Product Listing Slots
MoGiZ.com membership options and seller's fees are non-refundable and may change
at any time. MoGiZ.com also reserves the right to revoke membership access without
a refund if we determine a user has violated the site's terms and conditions or
has behaved in a manner that does not promote a positive experience for others on
the site.
Fraud Prevention/Theft
MoGiZ.com takes fraud prevention and theft prevention very seriously. We reserve
the right to delay or cancel any services that are a result of fraud prevention
and theft prevention practices. We also reserve the right to pursue any options
available legally to investigate, prosecute, fine, and imprison anyone that uses
this site that we believe is involved with illegal activities.
Chargebacks/Cancellation of Payment
Before cancelling payment or initiating a chargeback for any reason, contact our
support team to see if we can correct or clarify the charges. Failure to contact
our support team before cancelling payment may result in a failure to cancel or
reverse charges. We reserve the right to reverse any chargebacks that we, based
on our sole discretion, determine are not valid.
Disclaimer of Warranties and Limitation of Liability
Products/Services sold by MoGiZ.com that are not manufactured/serviced by MoGiZ.com
are not warranted by MoGiZ.com. We are acting as the reseller only. For these products/services,
the manufacturers/sellers may have warranty options available. MoGiZ.com will not
be held liable to perform against any manufacturer/sellers warranties. The customer
agrees to hold the manufacturer/seller responsible for any implied or express product
warranties, and not MoGiZ.com.
All products sold on MoGiZ.com are sold "AS-IS". MoGiZ.com will not be held liable
for claims of damage against the customer or property, malfunction, interruption
or loss of services.
This site is provided by MoGiZ.com on an "AS-IS" and "As Available" basis. We make
no representations or warranties of any kind, express or implied, as to the operation
of this site or the information, content, materials, or products included on this
site.
Member Conduct
Some of the content on this site is member generated. This content is the sole responsibility
of the person that submitted/posted the information and any associated graphics,
audio, or other media.
You agree that by using this site, you may be exposed to offensive or inaccurate
content posted by other users, and that you will not hold MoGiZ.com liable in any
way for damaged/confusion caused from such content.
To help protect the safety of others on this site, you agree NOT to do the following
while using this site:
- Upload or post any content that is offensive, unlawful, threatening, harmful, abusive,
harassing, invasive of another's privacy, hateful, or otherwise objectionable
- Impersonate any other person or entity
- Upload or post content that you do not legally have a right to upload or post
- Upload or post unsolicited advertising or promotional materials/content
- Upload content that is innacurate or untruthful
You agree that MoGiZ.com may, at its sole discretion, prescreen or remove content
provided by other users on this site if it violates the terms above, or if it is
harmful or disruptive in any way not described above.
You also agree to allow MoGiZ.com to collect information regarding your account
and activity according the terms in our
Privacy Policy.
Seller Requirements
If you choose to sell on MoGiZ.com, you agree to review and follow the terms and
instructions outlined in the
seller's guide.
Procedure for Filing Copyright or Other Infringement Claims
If you believe that your work has been copied in a way that constitutes copyright
infringement, please follow the steps below. Note: This procedure is only for notifying
MoGiZ.com that your copyrighted material has been infringed.
- Send a written notice to MoGiZ.com indicating the copyrighted work that you believe
has been infringed upon.
- Include a physical signature of the person authorized to act on behalf of the owner
of the copyright interest.
- Include a description of where you noticed the infringed copyright material (i.e.
URL, description of site location, etc.).
- Include a statement by you indicating that you believe the infringed material in
use was not authorized by the copyright owner, its agent, or the law.
- Include a statement by you, made under penalty of perjury, that the information
included in your notice is accurate and that you are the copyright owner or authorized
to act on the copyright owner's behalf.
